Judge Permits Halle Berry To Continue Work On "New Year's Eve" Film

Halle Berry and Gabriel Aubry

Both Halle Berry and Gabriel Aubry are in a chess match with their custody battle, each scoring a point.  According to the NY Daily News, Gabriel Aubry made another move in his custody battle with Halle.  He withdrew his custody petition, and filed a paternity action, to legalize his relationship with his daughter, Nahla.  The twist to the paternity suit is that, unlike the custody petition, it won't be open to the public and an eventual ruling will lead to support and visitation.

Halle's victory is that, in the meantime, she can take her daughter, Nahla, to New York City while she shoots the film "New Year's Eve" (the infamous film she withdrew from to deal with her custody issue with Aubry).  TMZ reported that Gabriel Aubry was trying to block Halle from going to NYC to shoot the "New Year's Eve" film.
